Travel Services Terms

Effective Date: November 2025

Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

“Agency” refers to BerliTravel, its employees, independent contractors, agents, and authorized representatives.

“Client” refers to the individual or entity entering into this Agreement and requesting travel-related services from the Agency.

“Services” refers to the travel planning, consulting, research, reservation management, itinerary coordination, and related support provided by the Agency as described in this Agreement.

“Supplier(s)” refers to third-party companies or individuals that provide travel-related goods or services, including but not limited to airlines, hotels, resorts, tour operators, cruise lines, transportation providers, insurance companies, and destination management companies.

“Booking” refers to any reservation, purchase, or arrangement made on the Client’s behalf with a Supplier, including but not limited to accommodations, transportation, excursions, tickets, packages, and insurance.

“Itinerary” refers to the travel plan, schedule, or proposal prepared by the Agency for the Client, which may include recommended destinations, accommodations, transportation, activities, and estimated pricing.

“Service Fees” refers to any planning fees, consultation fees, research fees, booking fees, change fees, cancellation fees, or other charges assessed by the Agency for its Services.

“Supplier Terms and Conditions” refers to the policies, rules, and contractual terms set by any Supplier involved in the Client’s travel arrangements, including but not limited to payment schedules, change/cancellation rules, refund policies, and liability limitations.

“Force Majeure Event” refers to circumstances beyond the reasonable control of the Agency or its Suppliers, including but not limited to natural disasters, government actions, strikes, pandemics, acts of terrorism, war, transportation shutdowns, or other unforeseen events that materially impact travel.

“Agreement” refers to this Client Service Agreement, including all appendices, attachments, updates, and referenced documents.

Scope of Services

BerliTravel agrees to provide the Client with comprehensive travel, relocation, and international mobility services as set forth below. Except for travel insurance underwriting or sales, the BerliTravel offers full support throughout the Client’s travel or relocation process, including consultation, visa application assistance, housing arrangements, and moving logistics.

Core Services

Work Abroad Full-Service Support

The BerliTravel provides end-to-end assistance for Clients seeking to work abroad, which may include:

  • Country and job-market research
  • Guidance on required documents for work programs
  • Assistance with completing visa applications and document preparation
  • Scheduling visa appointments and tracking application progress
  • Housing search and temporary accommodation arrangements
  • Arrival planning, orientation resources, and local logistics coordination
    BerliTravel does not provide legal representation or guarantee visa approval.

Retire Abroad Full-Service Support

The BerliTravel assists Clients planning long-term or permanent retirement abroad by offering:

  • Destination evaluations based on lifestyle, climate, and healthcare access
  • Long-stay or retirement visa application assistance and documentation support
  • Housing sourcing (short-term and long-term)
  • Coordination of moving logistics where applicable
  • Arrival assistance and expat support resources

Relocation Abroad Comprehensive Services

For Clients moving abroad for work, retirement, education, or personal reasons, the BerliTravel provides:

  • Customized relocation assessments
  • Visa application preparation and submission assistance
  • Local housing research and leasing coordination
  • Moving logistics support (international shipping referrals, customs guidance, pre-departure checklists)
  • Orientation, neighborhood guidance, and essential settling-in support

 Digital Nomad Transition Support

The BerliTravel assists Clients pursuing a location-independent lifestyle by providing:

  • Destination recommendations suited for remote work
  • Assistance with digital-nomad visa applications, document organization, and appointment scheduling
  • Housing and coworking space recommendations
  • Travel logistics, planning, and ongoing mobility support

Consultation Services

The BerliTravel offers ongoing consultation in areas including:

  • Travel planning
  • Relocation strategy
  • Budget planning
  • Country comparisons, safety guidance, and lifestyle suitability
  • Pre-move and post-arrival checklists

Travel Insurance Services (Limited Scope)

Insurance

We recommend that all persons on the booking purchase comprehensive travel insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. 

The BerliTravel may assist by:

  • Providing information about insurance options
  • Supplying referrals to approved insurance providers
  • Facilitating communication or connecting the Client to insurers
    BerliTravel does not sell, underwrite, manage, or guarantee any travel insurance products.

Please note that insurance companies usually limit the time between booking and/or departure date and the issuance of the policy and therefore we recommend purchasing the insurance immediately after receiving the confirmation of the booking from us. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses however arising, for which trip protection plan coverage would otherwise have been available.

Add-On Booking & Logistics Services

At the Client’s request, the BerliTravel may also coordinate and book:

Flights

Researching, recommending, and securing flight reservations.

Accommodations

Booking hotels, long-term rentals, temporary housing, serviced apartments, or relocation stays.

Tours and Activities

Arranging excursions, guided tours, cultural experiences, and recreational activities.

Ground Transportation

Coordinating rental cars, airport transfers, rail transportation, private drivers, or local mobility options.

Moving & Shipping Support

Assisting with coordination of international moving services, including:

  • Referrals to shipping companies
  • Assistance with customs documentation
  • Scheduling and logistical coordination

Travel Insurance Facilitation

Assisting in gathering quotes or submitting required details to an insurance provider, where allowed.

Limitations of Services

  • BerliTravel provides comprehensive support but cannot guarantee visa approval, job placement, immigration outcomes, or housing availability.
  • BerliTravel does not offer legal, tax, or financial advice.
  • All bookings and services are subject to Supplier Terms and Conditions.
  • Final responsibility for compliance with immigration and legal requirements remains with the Client.
Flight Schedule Disclaimer 

Guidance vs. Contractual Times

Any flight timings communicated during the booking process are purely indicative and non-binding, as they are subject to alteration. The actual and definitive flight schedule will be the one displayed on your e-tickets. It is mandatory that you check your e-tickets carefully upon receiving them, as times may change even after the issuance of tickets.

Changes to Carrier and Aircraft

We do not guarantee the airline, aircraft type, or specific airport being used when you book. Any such detail provided is provisional. A change in airline, aircraft, or airport does not constitute grounds for you to cancel or alter your booking without facing our customary fees.

Website Information Responsibility

Our website information is solely the responsibility of BerliTravel. It is not issued on behalf of any airline mentioned, or any airline whose services are used for your trip, and it does not commit them to any specific terms.

Travel by Minors

Minors must travel accompanied by an adult. BerliTravel will not organize trips for unaccompanied minors.

General Conditions of Air Transport

The airlines themselves determine the operational conditions of air transport and are solely responsible for all changes, including:

  • Schedule or route changes.
  • Stops and airport changes.
  • Delays and flight cancellations.

These circumstances are often unavoidable and occur for safety reasons, such as overbooking airspace, adherence to air navigation rules, and necessary aircraft maintenance.

Exclusion of Our Liability

We will not be liable for any schedule changes, delays, cancellations, or other circumstances that are:

  • Attributable to the carrier (airline).
  • Attributable to your own actions.
  • Attributable to the actions of a third party.
  • Caused by force majeure events.

Ticket Usage Warning

If your first scheduled flight (outbound) is not used, the carrier may automatically cancel the corresponding return flight segment.

Airport Arrival and Compliance

  • Arrival Time: Check-in times vary; arrive at the airport well ahead of your departure time.
  • Compliance: You must inform yourself and ensure you meet all current airline rules and governmental entry/transit requirements for all parts of your journey.

Ticket Change and Refund Status

Once you receive your flight e-ticket, the flight becomes non-refundable. Any subsequent change requests will be handled under the airline's specific change conditions and fees.

Confirm Before You Fly

Airlines can make last-minute changes or cancellations. You are required to confirm your flight status in the 48 hours before departure either with the airline or viawww.checkmytrip.com

Data Accuracy and International Liability

Personal Data and Communications

During the booking process, we require your personal and contact details to communicate any incidents that may affect your reservation. We must state that we accept no liability if our communication fails due to the data you provide being incorrect or incomplete.

Liability When Off Conveyance

Transportation companies, airlines, and similar entities are not responsible or liable for any act, omission, or event that occurs during the time when guests are not physically on board their planes, transport, or conveyances.

Benefits of International Conventions

We rely upon and assert the benefits of various International Conventions that limit liability for services provided by us, our suppliers, or agents. These conventions, which govern claims of any nature brought against us, include:

  • Air Travel: Warsaw Convention (and its protocols) or Montreal Convention.
  • Rail Travel: Berne Convention.
  • Sea Carriage: Athens Convention 1974.
  • Road Carriage: Geneva Convention.
  • Accommodation: Paris Convention 1962 (for Hotels).

We are entitled to and shall be regarded as having all the benefits of these conventions in limiting our liability in relation to any claim concerning death, injury, loss, damage, or delay to both guests and luggage.

Document Accuracy and Validity 

Mandatory Identity Match

Your travel documentation must use the exact name and surname as they appear on your official identification (Passport, ID card, or residence permit).

Your Obligation to Verify

Each passenger is personally responsible for confirming they hold valid travel documents that satisfy the regulations set by the following entities for all parts of the journey (including transit):

  • Airlines
  • Immigration
  • Destination Authorities

Rules for International Travel

  • Infants/Children: Every traveler, regardless of age, needs a valid travel document.
  • US Exit: Passports used for traveling outside the US must be valid for the duration of the planned trip.
  • Visa Details: Where a visa is necessary for a child or infant, the visa document must show the minor traveling with an adult figure in the photograph.

Documentation for Non-US Citizens and Check-in 

Non-US Citizen Requirements

All travelers who are not US citizens must have their travel documents validated and their boarding pass issued before proceeding through the airport security area.

Mandatory Compliance and Liability

To ensure regulatory compliance on all routes, passengers must carry a valid:

  • Passport (and visa, if required), OR
  • National identity card issued by the US government.

The passenger will be solely responsible for covering any fines, penalties, or costs incurred due to a breach of this documentation requirement.

Unacceptable Identification

The following forms of identification are not accepted as valid travel documents: Green Cards, driving licenses, family books, notepads, maritime identification, police reports for lost/stolen documents, and military identification cards, among others. Furthermore, photo IDs that are expired or damaged will not be accepted on any flight.

Online Check-in and Gate Presentation

The data from all passenger travel documents (including children and infants) must be entered during the online check-in process. On all routes, passengers are required to present both valid travel documents and the online boarding pass at the airport security area and again at the departure gate.

Client Responsibilities

To ensure the effective delivery of the Services described in this travel service terms agreement, the Client agrees to fulfill the following responsibilities:

Accuracy of Information

The Client must provide accurate, complete, and timely information as requested by the BerliTravel, including but not limited to:

  • Full legal names (as shown on passport)
  • Passport copies and identification documents
  • Employment history, financial documents, and other visa-related materials
  • Travel preferences, health considerations, and mobility needs
  • Contact information and emergency contact details

The BerliTravel is not responsible for delays, denials, or additional costs resulting from inaccurate, incomplete, or late information provided by the Client.

Document Preparation and Submission

While the Agency assists with visa applications, documentation, and related submissions, the Client is responsible for:

  • Reviewing all forms and documents for accuracy before submission
  • Signing any required documents or authorization forms in a timely manner
  • Ensuring they meet the legal requirements to apply for visas or residency programs
  • Notifying the Agency promptly of any changes in personal circumstances (e.g., employment, marital status, criminal history) that may affect visa eligibility

Passport, Visa, & Legal Compliance

The Client is responsible for ensuring:

  • Their passport is valid for the required duration specified by the destination country
  • They meet eligibility requirements for the visas they seek
  • They attend required visa interviews, biometric appointments, or consulate meetings
  • They comply with the laws, regulations, entry requirements, and conditions set by the destination country
  • They follow all work, residency, and travel rules after arrival

The Agency may assist with scheduling and preparation, but ultimate legal compliance is the Client’s responsibility.

We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. 

You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.

The airlines, in compliance with the requirements of the US Government, are legally obliged to allow the Bureau of Customs and Border Protection (CBP) US data to access certain travel and booking of passengers flying into / from or transiting through the US. This data is primarily used to prevent and combat terrorism, organized crime and other serious transnational criminal offenses.

Passport And Vaccination Notice

On all national and international trips, you must check the mandatory admission (e.g. US and ESTA, Canada and eTA or others authorities), passport validity (some countries require passport validity up to 6 months after the date of return) and vaccination requirements (vaccination guidelines and diagnostic tests), by the authorities of each of the countries of destination and/or stopover. Check the official websites of Immigration and health agencies of your country and of the countries of destination and stopover, as well as the requirements of the airlines. In the event of being denied by the authorities the exit or entry to the country of destination or transit, for particular reasons of the traveler for lack of the requirements that are demanded, due to a defect in the required documentation, and/or for not being a carrier of The same, BerliTravel declines all responsibility for events of this nature, resulting in any expense incurred by the traveler and applying the poli+cy of failure to show up at departure.

Special note on COVID-19/ Vaccination situation

Should a PCR or any travel requirements necessary to enter the destination or participate in any aspect of a purchased trip, the arrangements within the required timescale and related costs will be entirely the customer’s responsibility, and shall not be cause for a refund. Once the trip has begun, should the client present any symptoms related to COVID, resulting in the modification of the contracted services, (e.g. night's stay, changes of hotel or flights) any additional expenses will be the customers responsibility and must subsequently be claimed from their insurance company.  You agree that due to the sustained risk of contracting COVID anywhere in the world, by traveling you are assuming the risk of contracting COVID, including to all risks associated with COVID. You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS BerliTravel Co. LLC, its members, officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise

Review and Approval of Plans

The Client must:

  • Review proposed itineraries, relocation plans, visa applications, housing options, and logistics recommendations
  • Approve or request changes within a reasonable timeframe
  • Understand that Supplier availability and pricing may change if approvals are delayed

The Booking Process and Contract

To book your Travel service, you must follow our formal online booking procedure. If you are communicating with our Customer Service team, we can complete this process for you. By submitting the booking (or authorizing us to submit it for you) via our website, you confirm acceptance of these terms on behalf of every individual named in the reservation.

A definitive and legally binding agreement for your travel arrangements is established the moment we issue a confirmation document.

Verification is Essential

It is critical that you verify all travel booking details, including Legal personal information, before submission.

  • If booking through Customer Service, ensure that the information you provide is completely accurate and immediately check the confirmation (or any document issued) upon receiving it.
  • Changes may not be possible later, so review your details before completing the purchase. Should you require a change after confirmation, the terms set out in the "Changes" section of these Terms and Conditions will govern the process.
  • You can always review your current Travel service reservation details within your "My Account" area.

Supplier Terms, Liability, and External Information Supplier Terms and Liability Limitations

The services included in your arrangements are delivered by our suppliers (e.g., airlines, hotels) who operate under their own terms and conditions. These supplier terms are an integral part of your overall agreement with us. Be advised that these terms may limit or exclude the supplier's liability to you, often consistent with international conventions governing travel.

  • Insolvency Warning: While we take care in choosing our suppliers, please note that we cannot be held liable for any financial loss or disruption caused by supplier insolvency or bankruptcy.

External Representations and Warranties

We recognize that travel experiences are unique to each individual. BerliTravel will not be legally bound by or responsible for any description, photo, promise, or warranty provided by any independent third-party representative, travel agent, or other external entity concerning any travel service or vacation offered by us.

Payment Requirements and Deadlines

Payment Obligations

You are required to settle the cost of your travel arrangements strictly according to the payment schedule we provide.

  • Reservation and Start of service:  a deposit must be paid at the time of booking to secure your place and to s.
  • Balance: The remaining balance must be received by us in full, adhering to the informed installment due dates.
  • Late Bookings: Reservations made 70 days or less prior to the departure date require full payment at the time of booking.

Payment Schedule

Unless otherwise stated:

  • Service Fees are due before services are rendered.
  • Supplier Fees are due at the time of booking, submission, or Supplier request.
  • The Client must pay all outstanding balances prior to final itinerary delivery, relocation coordination, or submission of any visa-related documents.

Failure to pay on schedule may delay or halt services.

The Client must:

  • Pay all Agency Service Fees, deposits, and charges.
  • Pay Supplier fees (e.g., consulate fees, airline tickets, housing deposits, tour operators, shipping companies) when due

 Non-Refundable Fees

The Client acknowledges that:

  • Consultation, planning, research, and administrative fees are non-refundable
  • Fees paid to Suppliers are subject to Supplier refund policies
  • No refunds are provided for services already performed, even if travel plans change

Pricing, Inclusions, and Extra Charges 

Determining Your Total Price

The total cost of your selected travel services is calculated based on the specific services, travel dates, and the total number of individuals in your reservation. Before finalizing your purchase, you are responsible for reviewing the sections of your inquiry clearly labeled "the price includes" and "price does not include."

Local Taxes and Fees

Be aware that certain countries or specific hotels and services may require you to pay a local fee or tourist tax directly upon arrival or locally. Please note that we are not responsible for those fees, the client is the one responsible.

Price Adjustments and Fees

  • Unsold Arrangements: We maintain the right to adjust the price of any add-on travel services/ arrangements that have not yet been sold at any time.
  • Confirmed Bookings: We also reserve the right to correct any errors in the price of bookings that have already been confirmed.
  • Non-Refundable Fee: A separate non-refundable handling fee of 100 USD will be applied to all your Travel service package. This fee is separate from, and in addition to, the price of your travel package.

Failure to Pay

If we do not receive any required payment in full by the due date, we retain the right to consider your booking/ travel services cancelled by you. In this event, the applicable cancellation fees detailed in the section "Cancellations by the Customer" will be immediately applied.

Credit Card and Chargeback Policy

By paying with a credit card, you agree to be bound by our cancellation policies. You also agree to waive your right to initiate a chargeback, except in verified cases of fraud. Should you pursue a chargeback that we are required to dispute, you will be held responsible for covering all of our resulting costs, including any necessary attorney's fees.

General Cancellation Rule

Partial cancellation of a booking is strictly not permitted. Should any customer(s) wish to cancel their confirmed reservation, the entirety of the cancellation policy detailed in this section will be applied to the booking.

Basis for Penalties

Prior to cancellation, BerliTravel incurs various expenses that are non-recoverable. Consequently, any penalties levied are directly proportional to these non-refundable costs. In the event of a customer cancellation, BerliTravel reserves the right to claim the applicable penalty fee and, in all cases, reimbursement for any costs or expenses already incurred.

Rules for Added Products/Services

Services or products purchased after the initial reservation date cannot be cancelled if the departure date is less than SIXTY (60) days away. Any cancellation of these supplementary items made within the 60-day window before the trip will incur a penalty equivalent to ONE HUNDRED PERCENT (100%) of the cost of the added service.

Cancellation by the Customer

Once a partial or total payment has been made, cancellations will only be accepted in writing. In the event that the Client wishes to request the cancellation of his reservation, he must send his request through the cancellation form in the portal.

Your notification of cancellation request will only take effect once it is received in writing, and in the event that the reception is made outside the operating hours of our Customer Service team, it will take effect from the next business day (check the operating hours in the "Contact" section of our website). If there are specific cancellation conditions for a given trip, they will be indicated in the "conditions" section of the offer. If there are no specific conditions, the cancellation fees set out below will apply.

At any time prior to the start of the combined trip, the traveler may cancel the trip and, in that case, the cancellation policy and applicable cancellation fees for customers who wish to cancel their trip voluntarily will be:

  • If the cancellation occurs SIXTY (60) or more days prior to the departure date of the trip, the amount corresponding to the (60%) of the total amount of the booking will be deducted as a penalty.
  • If the cancellation occurs FIFTY-NINE (59) or less days before the departure date of the trip, SEVENTY-FIVE PERCENT (75%) of the total amount of the trip will be deducted as a penalty.

Service Fees are non-refundable unless otherwise stated in writing by the Agency.

Price Changes

All quotes, unless otherwise stated in writing, are estimates. Final pricing is determined by Supplier policies, market conditions, availability, and currency fluctuations. The Client agrees to pay any updated amounts required by Suppliers.

Special Request

Special requests relating to your arrangements must be advised to us at the time of booking and confirmed to us in writing. While we will try to meet or arrange your reasonable special requests, we cannot guarantee that they will be fulfilled. Special requests that have been noted on your confirmation or any other documentation do not amount to a promise to meet that request. A failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed.

Health Needs and Suitability 

Disabilities and Medical Conditions

If you or any member of your party has a medical condition or disability that could impact your travel arrangements, you must provide us with complete details before your booking is confirmed. This allows us to assess the suitability of the arrangements and attempt to accommodate your needs.

Right to Refuse or Cancel

  • Accommodation Unable: If, acting reasonably, we determine that we cannot adequately meet your specific requirements, we reserve the right not to confirm your booking.
  • Non-Disclosure: If you failed to provide us with the necessary details at the time of booking, and we become aware of these details later, we will treat your reservation as cancelled by you, and standard cancellation terms will apply.

Penalty Application and Insurance Claims

Penalty Application and Deductions

These terms apply without prejudice to any optional insurance coverage you may have contracted in subsequent clauses.

Any applicable penalties and necessary management expenses will be deducted from the total amount of payments previously collected by BerliTravel. Furthermore, the initial handling fees you paid are non-refundable in the event of customer cancellation.

Insurance Recourse

If the reason for your cancellation is covered under the terms and conditions of your travel insurance policy, you have the right to claim reimbursement for these charges (penalties and costs) directly from your insurance provider.

Cancellation or Alteration by BerliTravel

BerliTravel reserves the following rights to change or cancel the arrangements:

  • Change Dates: To amend the scheduled departure or conclusion date of the trip.
  • Minor Adjustments: To modify any aspect of the trip that is deemed non-essential.
  • Itinerary Changes: To cancel or modify the entire trip, specific routes, or planned objectives outlined in the itinerary.
  • Insufficient Participation: To cancel the trip if the required minimum quota of registered travelers needed to consolidate and execute the trip is not met.

Consequences of Company Changes and COVID-19 Acceptance of Risk for Alterations

In the event that BerliTravel makes any change, modification, cancellation, postponement, or delay under the preceding condition you acknowledge and agree to the following:

  • You will not receive a cash refund for the trip price (neither partial nor full).
  • You forfeit the right to claim compensation for any injury, loss, damage, or other additional expenses incurred as a result of the alteration, modification, or delay.

Special Note on COVID-19 Requirements

All costs associated with the mandatory presentation of a PCR test or any other entry requirement mandated by the destination country are the sole responsibility of the client. This includes the client's responsibility for ensuring the test is completed within the destination's required timeframe.

If a client experiences COVID-19 symptoms after the trip has commenced, resulting in required modifications to contracted services (e.g., unexpected overnight stays, hotel changes, or altered flights), the clients must cover these extra costs. These subsequent expenses should then be claimed back directly from their travel insurer.

Changes Requested by the Customer 

Submitting Your Change Request

If you need to make any alterations to your confirmed travel arrangements, you must notify us in writing as soon as possible, using the "Contact Us" form available on your travel app

Effective Date and Consequences

Your written request for a change becomes officially effective upon receipt. If the notice is received outside of our Customer Service operating hours, it will only be processed starting the next business day (our hours are listed in the "Contact" section).

  • Inability to Change: If we are unable to accommodate your requested change, and you subsequently decide not to proceed with the original booking, this will be classified as a cancellation initiated by you. In this scenario, the fees and conditions detailed in the Cancellation Policy will apply, based on the proximity to your departure date.

Fees and Charges

While we cannot guarantee all changes can be fulfilled, we will make every effort to assist you. If we are successful in meeting your request, you will be responsible for:

  • Any increase in the price of the arrangements.
  • All additional costs incurred by BerliTravel.
  • Any fees or charges imposed by our suppliers.

Limitations on Specific Services

Be aware that certain components, especially amounts paid for flights, often cannot be amended after confirmation. Any alteration or cancellation to these specific parts could result in a charge of up to 100% of that element of the arrangements, which is in addition to the charges mentioned above.

Changes Initiated by BerliTravel

Our Right to Alter or Cancel

Since we organize your travel arrangements well in advance, we must retain the right, in certain circumstances, to make changes to your booking or to cancel it entirely.

Minor Changes and Notification

The majority of changes we make will be minor in nature. We commit to notifying you of these minor alterations as soon as is reasonably possible before your departure. However, in respect of these minor changes, we will incur no further liability to you.

Definition of "Minor Changes"

Examples of adjustments categorized as "minor changes" before departure include:

  • Any alteration to the overall length of your arrangements that totals twelve hours or less.
  • The substitution of your reserved accommodation with another property that holds the same standard or classification.

Major Changes to Confirmed Arrangements

Defining Major Changes

In rare instances, we may be forced to implement a significant alteration to your confirmed arrangements. Before departure, a "major change" is defined by one of the following examples:

  • Location Swap: A change in the accommodation area for either the entirety or a substantial portion of your travel duration.
  • Downgrade: Substitution of your accommodation with a property of a lower standard or classification for the whole, or a significant part, of your time away.
  • Duration Alteration: An adjustment to the overall length of your arrangements totaling twelve hours or more.
  • Itinerary Removal: A substantial alteration to your itinerary that results in the complete omission of one or more destinations.
  • Group Cancellation: The total cancellation of the trip specifically due to a failure to meet the minimum number of registered travelers required to consolidate the group (this applies exclusively to group travel bookings).

Recourse for Company Alterations 

If BerliTravel must make a major alteration to your booking or cancel the trip, we will inform you as quickly as possible. If time permits before departure, you will have the following three options:

  • Option 1: Proceed. Accept the altered travel arrangements.
  • Option 2: Money Back (Credit). Receive a full refund of all amounts paid, issued as a Travel Credit.
  • Option 3: Substitute Trip. Choose an alternative arrangement of similar quality that we are able to offer.
    • Note on Value: If the alternative is cheaper, we will issue the difference as a Travel Credit. If the alternative is more expensive, you must pay the additional amount.

Response Deadline and Exclusions 

Response Timeframe

You must inform us of your decision regarding the options presented (acceptance, refund, or alternative) within 72 hours of receiving our offer. If we do not receive your notification within this deadline, we will automatically assume you have chosen to accept the change or the alternative arrangements offered.

Exclusions to Compensation

We will not offer compensation or provide the options listed previously (refund or alternative trip) in the following circumstances:

  • Minor Change: When the change we make is classified as a minor change (as previously defined).
  • Payment Failure: If the cancellation is a direct result of your failure to make payments according to the terms of this agreement.
  • Customer Request: When the change or cancellation by us is a consequence of alterations you previously requested for your confirmed booking

Mid-Trip Disruptions and Compensation Limits 

Handling Mid-Trip Service Loss

If a major portion of your booked arrangements cannot be supplied after your trip has begun, we commit to offering substitute arrangements. If no acceptable alternative can be secured, or if you decline the available options for justifiable reasons, we will provide suitable return transport to your starting location or to an agreed-upon alternative

Package Compensation and Force Majeure

For package bookings, we will pay you reasonable compensation where appropriate. However, if the cause of the change or cancellation is deemed "force majeure" (see subsequent section), we accept no liability to pay compensation, issue refunds, or cover any costs you experience.

Final Note: This section represents the absolute limit of our responsibility for any changes or cancellations. We cannot reimburse you for any other incidental expenses or losses resulting from these events.

 Reporting Issues 

Addressing Complaints

  1. Immediate Notification: If a problem arises during your holiday, inform the supplier in question right away to allow for immediate resolution. You may also contact us via the "Contact Us" form or our pre-communicated Emergency line.
  2. Formal Follow-up: If the problem persists, you must send us a formal written complaint detailing your booking reference and all facts within 28 days of the end of your trip.

Important Warning: Failure to follow this exact procedure could compromise our ability to investigate your concerns and may subsequently reduce your contractual rights related to the complaint.

Your Conduct and Contract Termination

Right to Terminate Services

We reserve the right to immediately cancel your arrangements if, in our opinion or the opinion of a person in authority, your behavior poses a risk of distress, danger, damage, or annoyance to other parties or property, or causes a delay or disruption to transport services.

Financial and Legal Effects of Termination

Upon termination due to unacceptable conduct:

  • Our contract and all responsibilities to you end immediately.
  • You must leave your hotel or service instantly.
  • We are not obligated to pay for any expenses, costs, or losses you suffer as a consequence.

Damage Responsibility

You are liable for any loss and/or damage your actions cause to the supplier's property. You must pay the supplier directly before departure. If you fail to do so, you will be liable for all subsequent claims and costs levied against BerliTravel as a result of your behavior.

Our Responsibilities and Liability 

Our Role as Organizer

We accept our legal obligations as the organizer under the Package Travel service  in the US.

Subject to these booking conditions, we will pay you reasonable compensation if we or our suppliers negligently fail to perform or arrange the services detailed on your booking confirmation.

Note on Claims: It is your responsibility to provide evidence that either we or our supplier(s) acted negligently if you choose to make a claim against us.

Exclusions from Our Responsibility

We are not responsible for, and will not pay you compensation for, any injury, illness, death, loss, damage, expense, cost, or other claim if it results from:

  • Your Actions: The act(s) or omission(s) of the person(s) affected (the traveler).
  • Unconnected Third Parties: The act(s) or omission(s) of a third party who is unconnected with the provision of the contracted services and whose actions were unforeseeable or unavoidable.
  • Unforeseeable Circumstances: Unusual or unforeseeable circumstances that are beyond our or our supplier's control, the consequences of which could not have been avoided even if we had exercised all due care.
  • Unforeseeable Events: An event that neither we nor our suppliers could have foreseen or forestalled, even by exercising all due care.

Assistance and Liability Limitations 

Assistance in Difficult Circumstances

If your arrangements qualify as a package holiday, we may offer you reasonable assistance should you encounter difficulties arising from the circumstances detailed previously (such as acts of third parties or force majeure events).

Further Exclusions from Compensation

We will not be responsible for, nor will we pay you compensation for, the following:

  • Non-Contracted Services: Any services or facilities that are not part of our agreement with you or which were not advertised by us. This includes, for example, any independent excursions booked while traveling, or any service that a hotel or supplier agrees to provide for you outside the scope of your confirmed booking.
  • Unforeseeable Damages: Any damage, loss, expense, or other sum that, based on the information you provided to us before the booking was confirmed, we could not have reasonably foreseen you would suffer or incur if we breached our contract with you.
  • Business-Related Losses: Any loss or expense that relates to any business activities.

Risk of Loss and Claim Requirements 

Transport of Personal Property

Your personal belongings and luggage are carried at your risk and must remain under your supervision. During transport by air, rail, sea, or river, the terms stipulated by the specific carrier will apply, as evidenced by your passenger ticket. If your luggage is harmed, lost, or delivered late, you must file a report with the carrier immediately.

Factors Affecting Your Payout

The total compensation amount payable will be calculated based on various considerations, including:

  • Timely Reporting: Our acceptance of liability depends on you strictly adhering to the complaints procedure by notifying both us and the supplier(s) of your claim on time.
  • Extent of Fault: We assess the percentage to which the negligence of our staff or suppliers detracted from your total enjoyment of the arrangements.
  • Offsetting Payments: We reserve the right to subtract any money that you have already received, or are due to receive, from the transportation provider or hotelier for the specific complaint before issuing our compensation payment.

Payment Conditions and Service Delivery 

Conditions of Accepting Compensation

Acceptance of any payment from us constitutes an agreement that the recipient (or their legal guardian, if a minor) will transfer to us or our insurers the right to pursue claims against any responsible third party. The recipient is also obliged to give us and our insurers all necessary cooperation and assistance requested for these legal pursuits.

Our Service Guarantee

We guarantee the provision of the accommodations and services detailed in the relevant website brochure for your trip. However, our responsibility is limited when the services are unavailable or the itinerary changes due to delays or any other cause outside our direct management.

In these unavoidable situations, we and our suppliers will attempt to substitute the affected services with comparable alternatives and itineraries. Under these specific conditions, no refund will be given.

Limits of Liability for Third Parties

Exclusion of Liability (The "Released Parties")

BerliTravel, along with its suppliers, partners, agents, and employees (collectively, the “released parties”), is not responsible or liable for issues arising from third-party service providers, including:

  • Service Changes: Acts, variations, postponements, substitutions, or defaults by hotels, carriers, transportation companies, or other service providers, including resulting changes to services or facilities.
  • Non-Employees: Any injury, illness, death, loss, damage, or claim resulting from the negligence, error, or omission of any person not directly employed by or under the exclusive control of the released parties, including governmental entities.

The released parties explicitly disclaim liability for indirect, special, or consequential damages.

Property and Baggage Rule

The participant assumes all risk for all baggage and personal effects throughout the duration of the guided vacation. BerliTravel strongly advises that you secure specific baggage insurance. If lost items are recovered, the customer is fully responsible for all arrangements and costs required to have the items returned.

Relationship with Suppliers and Legal Jurisdiction 

Our Relationship with Providers

The hotels, carriers, and all other service providers involved in your trip are operating as independent contractors. They have no employment, agency, or servant relationship with BerliTravel or its affiliated businesses.

Document Governance

Travel documents issued by BerliTravel for services are subject to the following rules:

  • Supplier Rules: The terms and conditions enforced by the carriers and suppliers themselves.
  • Local Laws: The legal framework of the countries where the services are performed.
  • Marine Transport: Transportation by sea is specifically governed by the Carrier’s Conditions of Carriage, which are part of this agreement (copies available upon request).

Disclaimer for Third-Party Actions

The released parties are not liable for any conduct by third parties—be it criminal, grossly negligent, intentional, or negligent—that results in loss or damage.

Travel Risks and Indemnification 

Acceptance of Specific Risks

You understand that your trip may involve inherent dangers beyond the typical risks of organized travel. These dangers include, but are not limited to, those related to: primitive areas, transportation methods, wildlife, political volatility, differing sanitation standards, and lack of emergency medical facilities or rapid evacuation. This list is illustrative, not exhaustive.

By proceeding with this booking, you confirm that you are voluntarily accepting all risks and dangers involved in the trip activities.

Legal Waiver

As part of the consideration for the opportunity to travel with BerliTravel, you legally agree:

  • No Claim Covenant: You will not sue or pursue any claim against BerliTravel, its related entities, or personnel for any bodily injury, death, emotional trauma, or property loss/damage, regardless of cause, arising from your participation in this trip.
  • Full Release: You completely release BerliTravel and its affiliates from all claims, whether anticipated or not, connected to your trip.

This binding agreement applies to you, your entire party (including minors), and your legal successors.

Travel Safety and Insurance 

Security and Trip Alterations

Security concerns and governmental travel advisories may necessitate changes to your itinerary or accommodations, or even lead to cancellation. You must acknowledge and accept the risks of travel in affected areas, and your choice to travel remains your own decision and responsibility.

Insurance is Critical

We highly recommend that all guests secure comprehensive Travel Insurance. Since some destinations require foreign visitors to have valid medical insurance for entry, please note that we are not responsible for denied entry resulting from your failure to present required insurance details or denial for any other reason.

Billing, Documentation, and Responsibility 

Correction of Billing Errors

In the event of a computer or human billing error, we explicitly reserve the right to re-invoice participants with the correct billing amount.

Documentation Accuracy Disclaimer

While we strive for brochure accuracy at the time of publication, BerliTravel cannot be held liable for:

  • Printing or typographical errors.
  • Errors arising from unforeseen circumstances.

Furthermore, photographs and location descriptions are representative of conditions only at the time of brochure printing; actual conditions at the time of your trip may differ.

Applicability of Supplier Terms

All bookings made with independent providers (transport, hotels, meals, etc.) are subject to the specific terms, conditions, exclusions, and limitations of liability imposed by those providers concerning any matters not explicitly covered in our agreement.

Travel Decisions Due to Government Requirements

If you choose not to visit a country or area of a country due to any law, condition, or requirement imposed by a government or governmental authority, you will be responsible for all resulting costs, expenses, charges, fees, losses, or damage incurred, including any applicable cancellation or amendment fees.

Neither BerliTravel nor its staff or agents accept any responsibility or liability for your personal acts, omissions, defaults, conduct, state of health, condition, or circumstances.
